Note by the Secretariat

 

 

            The following communication, dated 3 July 2000, was sent by the Chairman of the Panel to the Chairman of the Dispute Settlement Body:

 

            "On 29 May 2000, the United States appealed the reports of the panels in United States - Anti-Dumping Act of 1916 (WT/DS136 - complaint by the European Communities and WT/DS/162 - complaint by Japan).  The report in WT/DS162 as circulated to Members on 29 May 2000 does not include sections III and IV.

 

            It is the understanding of the Panel that the parties agreed to the circulation of a report in that form so as to allow the Appellate Body to hear concurrently the appeals filed by the United States in the two cases.  Due to a lack of translation capacity in the WTO Secretariat, such a concurrent appeal would not have been possible if the parties had not agreed to this arrangement.

 

            It is the Panel's understanding that sections III and IV of its report in WT/DS162 will be circulated to Members in August 2000.
