Constitution of the Panel Established

at the Request of the United States

Note by the Secretariat

1.     At its meeting on 25 February 1997, the DSB established a panel pursuant to the request of the United States (WT/DS56/5), in accordance with Article 6 of the DSU (WT/DSB/M/29).

2.     At that meeting, parties agreed that the Panel should have standard terms of reference.  The terms of reference of the Panel are therefore the following:

"To examine, in the light of the relevant provisions of the covered agreements cited by the United States in document WT/DS/56/5, the matters referred to the DSB by the United States in that document and to make such findings as will assist the DSB in making the recommendations or in giving the rulings provided for in those agreements."

3.     On 4 April 1997, the Panel was constituted with the following composition:

            Chairman:Mr. Peter Pale_ka

        Members: Ms. Heather Forton

                        Mr. Peter May

4.     The European Communities, India and Hungary have reserved third-party rights to participate in the panel proceedings.
