Recourse by Korea to Article 21.5 of the DSU

The following communication, dated 20 October 2000 and addressed to the Chairman of the DSB, has been received from the Permanent Missions of Korea and the United States.

_______________

The Republic of Korea and the United States of America wish to notify the Dispute Settlement Body of a mutually satisfactory solution to the matter raised by Korea in United States – Anti-Dumping Duty on Dynamic Random Access Memory Semiconductors (DRAMS) of One Megabit or Above from Korea (WT/DS99).

The mutually satisfactory solution involves the revocation of the anti-dumping order at issue in this dispute as the result of a five-year "sunset" review by the US Department of Commerce.  The Department of Commerce published its determination to revoke the order in the Federal Register on 5 October 2000.  65 Fed. Reg. 59391.

Based on this development, the United States and Korea have agreed that a mutually satisfactory solution has been reached with respect to the matter raised by Korea.  We would ask you to circulate this notification to the relevant Councils and Committees, as well as to the DSB.
