Replies to questions posed by the United States[1] regarding
the new and full notification of the european union (Austria).[2]

The following communication, dated and received on 25 April 2022, is being circulated at the request of the delegation of the European Union.

Question 1

a.        For the program entitled "UPPER AUSTRIAN PROGRAMME FOR INNOVATION AND ECONOMIC GROWTH 2020", how does the program encourage export? Are incentives tied to the ability of recipient companies to export?

Reply

The program entitled "UPPER AUSTRIAN PROGRAMME FOR INNOVATION AND ECONOMIC GROWTH 2020" targets the strengthening and safeguarding of the innovation potential and the growth potential of companies as well as the sustainable securing and creation of qualified jobs. The overarching objective of the present program is to achieve "high" positive environmentally friendly effects through (new) environmentally friendly processes and/or to obtain environmentally friendly products from those applying for funding. This program is intended in particular to increase innovative strength and the competitiveness of SMEs is supported.

b.        Please explain how this program is consistent with Article 3 of the SCM agreement?

Companies are not required to export nor to use domestic over imported goods to qualify for this subsidy.

Question 2

a.        For the program entitled "UPPER AUSTRIAN PROGRAMME TO SUPPORT INNOVATIVE SKILLS FOR SME", what training is provided to focus on exports? Are only exporters eligible for this training incentive?

The program entitled "UPPER AUSTRIAN PROGRAMME TO SUPPORT INNOVATIVE SKILLS FOR SME" promotes training measures in the focus on digitization, technologies, innovation and foreign languages to strengthen the innovative power and competitiveness of the business location in Upper Austria. The program is designed as a so called „Qualification program" targeting the requalification and upskilling of digital skills. For funding under the program the participation in training measures which are organized by professional training companies or training trainers are required and can be used across companies. Since it is not the case that the applicant has to be an exporter, it is not just exporters who are eligible for this training grant. Regardless of whether it is a domestic or external service.

b.        Please explain how this program is consistent with Article 3 of the SCM agreement?
