Brief
description of the notified legal text The Public Contracts Regulations 2015 and the Public Contracts
(Scotland) Regulations 2015 came into force in 2016 and provide the legal
framework for procurement by contracting authorities with respect to public
contracts and design contests. In 2021 various amendments were made to these regulations which arose
from the UK acceding to the Agreement on Government Procurement (GPA) in its
own right and reflecting modifications to the United Kingdom’s Appendix I of
the GPA following the UK’s Article XIX notification which came into effect on
16 May 2021. None of these amendments are substantive. These amendments were made by the Public Procurement (Agreement on
Government Procurement) (Amendment) Regulations 2021 made on 12 May 2021
which entered into force on 11 June 2021 (www.legislation.gov.uk/uksi/2021/573/made) and the Public Procurement
(Agreement on Government Procurement) (Amendment) (No. 2) Regulations 2021
made on 20 July 2021 which entered into force on 16 August 2021. (www.legislation.gov.uk/uksi/2021/872/made) These regulations were made using powers in the Trade Act 2021 came
into force on 29 April 2021. (www.legislation.gov.uk/ukpga/2021/10) Further amendments concerning updating the UK’s thresholds and to
change the calculation of the estimated value of a procurement based on the
total amount payable without making a deduction for value added tax will be
made by the Public Procurement (Agreement on Government Procurement)
(Thresholds) (Amendment) Regulations 2021 made on 29 October 2021
which will enter into force on 1 January 2022 (www.legislation.gov.uk/uksi/2021/1221/made) and the Public Procurement
(Agreement on Government Procurement) (Thresholds etc.) (Amendment)
(Scotland) Regulations 2021 (www.legislation.gov.uk/ssi/2021/378/made) (as amended by the Public
Procurement (Agreement on Government Procurement) (Thresholds etc.)
(Amendment) (Scotland) Amendment Regulations 2021) Made 29 October 2021 which
comes into force on 1 January 2022 (www.legislation.gov.uk/ssi/2021/424/made). These amendments were made using powers in the Trade Act 2021, the
Public Contracts Regulations 2015, the Concession Contracts Regulations 2016,
and the Utilities Contracts Regulations 2016 and for Scotland, the Trade Act
2021, the Public Contracts (Scotland) Regulations 2015, the Utilities
Contracts (Scotland) Regulations 2016, and the Concession Contracts
(Scotland) Regulations 2016. |
