This Corrigendum is being circulated following clarifications received from the Parties.
Question 1.78, pages 25-26: The last sentence of the response to Philippine's question on Provisions on Trade in Goods, Agriculture is reproduced below.
"Note - the text of paragraph 3.119 of the Factual Presentation is not fully accurate and should be revised."
Following a request for clarification from the Secretariat, the Parties have proposed a new text for the second sentence in the chapeau to paragraph 3.119 of the Factual Presentation:
3.119. (….) In addition to
prohibitions on export subsidies and special safeguards
for Japan (see described in Sections 3.4.4 and 188.8.131.52.1 above ),
these include: (…)
Accordingly, the Secretariat is issuing a Revision to the Factual Presentation (WT/REG395/1/Rev.1) with this updated text.
Question 1.84. pages 27-28: The last sentence of the response to the Philippine's question on Liberalization Commitments, the paragraph should be amended to read as follows:
As noted above, the Market Access obligations under Chapter 10 are cross applied to mode 3 supply of a service in a Party's territory by a covered investment. Section 4.4 of the WTO Secretariat's Factual Presentation, including paragraphs 4.27-4.37 and Table 4.3 contain a detailed comparison of CPTPP Parties commitments, including in respect of mode 3, in comparison to their commitments under the GATS.
Question 1.115, pages 38-39: The first paragraph to the response to the question from the delegation of the Separate Customs Territory of Taiwan, Penghu, Kinmen, and Matsu on Appendix 1 Australia, Liberalization of Trade in Services, Table 3.1: Australia and paragraph 1.21 is reproduced below.
"Australia appreciates the questioner identifying an error in the summary at Table 3.1 of the Factual Presentation."
Following a request for clarification from the Secretariat, Australia's CPTPP team has reviewed the issue and has advised that the Secretariat can revert to its original drafting.
Australia also indicates that "Australia's commitments against 'Libraries, archives, museums and other cultural services' are described as 'partial' in the Factual Presentation as Australia does not reserve the right to adopt or maintain any measure with respect to all of the services in this sector. Australia does not list an Annex II entry at the central level of government that reserves the right to adopt or maintain any measure with respect to 'other cultural services' or 'other cultural industries'. The July update of 395-1A1 ensures that the entry for para 3.21 correctly reflects Australia's level of commitment in this sector."
Accordingly, the Secretariat is issuing a Revision to the Factual Presentation's Appendix 1 - Australia (WT/REG395/1/Add.1/Rev.1) with an updated text. That revision will also entail a revision of some tables in the (general) CPTPP Factual Presentation, also to be included in its Revision (WT/REG395/1/Rev.1).
