NOTIFICATION of regional trade agreement

PACIFIC AGREEMENT ON CLOSER ECONOMIC RELATIONS PLUS (PACER PLUS)

Parties to the Agreement:

Australia, Cook Islands, Kiribati, New Zealand, Niue, Samoa, Solomon Islands, Tonga

Nauru, Tuvalu and Vanuatu have signed the PACER Plus but are yet to ratify the Agreement.

Date of signature:

14 June 2017 (Australia, Cook Islands, Kiribati, Nauru, New Zealand, Niue, Samoa, Solomon Islands, Tuvalu, Tonga) and 7 September 2017 (Vanuatu)

Date(s) of entry into Force:

13 December 2020 (Australia, Cook Islands, Kiribati, New Zealand, Niue, Samoa, Solomon Islands, Tonga).

The Agreement is not yet in force for Nauru, Vanuatu and Tuvalu.

Brief description of the Agreement:

PACER Plus establishes a free trade area for trade in goods and services within the meaning of GATT 1994 Article XXIV and GATS Article V.

The Agreement contains provisions on (a) trade in goods; (b) rules of origin and verification procedures; (c) customs procedures; (d) sanitary and phytosanitary measures; (e) trade in services; (f) movement of natural persons; (g) investment; (h) development and economic cooperation; (i) general provisions and exceptions; (j) institutional provisions; (k) transparency, and (l) consultations and dispute settlement.

The Agreement contains schedules of commitments for trade in goods, services, movement of natural persons, and investment. The Agreement establishes a Joint Committee to oversee its implementation.

The Parties to the Agreement include a number of non-WTO members (Cook Islands, Kiribati, Niue). Nauru and Tuvalu are also non-WTO Members who have signed but not yet ratified the Agreement.
