Kazakhstan - List of Article II (MFN) Exemptions

Entry and presence of natural  persons

Measures based on existing and future agreements are aimed at creation of preferential conditions for the movement of natural persons supplying services

Parties to the Partnership and Cooperation Agreement between the Republic of Kazakhstan and the European Communities and their Member states signed at 23 January 1995 with future supplements; CIS countries, all parties to existing and future respective agreements.

Measures are aimed at progressive liberalization between the Republic of Kazakhstan and its regional trade partners.

2.  Communication services

D.  Audiovisual services 

 

 

 

 

-    Production and distribution of television programmes and cinematographic works;

Measures based upon co production agreements of audiovisual works, which confer National Treatment to audiovisual works covered by such agreements.

All countries with whom cultural cooperation may be desirable

The aim of these agreement is to promote cultural links between the countries concerned

-    Production and distribution of television programmes and cinematographic works;

Measures granting the benefit of support programmes to audiovisual works, and suppliers of such works meeting origin criteria.

These programmes aim at preserving and promoting the cultural identity of countries with which Kazakhstan has a long-standing cultural links

-    Production and distribution of audiovisual works through broadcasting or other forms of transmission to the public

Measures which extend National Treatment to audiovisual works which meet certain origin criteria regarding access to broadcasting transmission.

All countries with whom cultural cooperation may be desirable

Indefinite.

These measures aim, within the sector, to promote cultural values both within Kazakhstan, and with other countries, including in the region and also at promoting Kazakhstan cultural values and linguistic policy objectives toward the youth.

5.  Educational services

Measures with respect to opening and activity of branches.

Azerbaijan, Armenia, Belarus, Georgia, Kyrgyz Republic, Moldova, Russia, Tajikistan, Turkmenistan, Uzbekistan, Ukraine, all parties to existing and future respective agreements .

These measures are aimed at preservation and development of relations in the field of education.

11. Transport services 

 

 

 

 

A.  Maritime transport

 

Special regime of shipping in the Caspian sea.

 

Measures in relation to the establishment, activities and operations of shipping companies

Azerbaijan, Iran, Russia, Turkmenistan.

B.  Inland waterways transport

a)  Passenger transportation

The measures, providing preferential regime for transportation of passengers and cargoes in pools of the rivers Irtysh and Ili.

These measures are aimed at building conditions for transportation of passengers and cargoes based on reciprocity principles in pools of the internal rivers of Kazakhstan

С.  Air Transport Services Selling and marketing

Measures concerning establishment of companies and opening of representative offices, applied on the basis of reciprocity.

All parties to existing and future respective air transportation agreements.

Indefinite.

Implementation of the conditions for supply of air transport services established in the framework of the existing bilateral air transportation agreements.

E. Rail Transport Services

a)  Passenger transportation

b)  Freight transportation

Measures maintained in the framework of the existing and future agreements regulating the rules of carriage, the terms of operation and transportation, supply of services in the territory of Kazakhstan and between the countries – parties to the agreements.

All parties to existing and future agreements.

These measures are aimed at ensuring the integrity of railway transport as a single production and technological complex, regulation of carriage in the territory of the Kazakhstan and between the countries – parties of the agreements.

F.  Road transport (passenger and freight)

Provisions in existing or future agreements on international road transport (including combined transport - road/rail) and passenger transport, concluded between the Kazakhstan and other WTO Members and third countries, which:

 

-    reserve or limit the provision of a transport service between the contracting parties or across the territory of the contracting parties to vehicles registered in each contracting party.

-    provide tax exemption for those vehicles.

1)  The countries, with whom agreements on realization of the international road transport are concluded:

 

Pakistan, Finland, Azerbaijan, Turkmenistan, Bulgaria, Germany, Latvia, Uzbekistan, Moldova, Turkey, China, Ukraine, Iran, Lithuania, Mongolia, Hungary, Poland, Tajikistan, Georgia, France, Estonia, Netherlands, Spain, and Czech Republic. 

 

2)  The countries, with whom agreements on realization of the international road transport will be concluded:

 

Norway, FYROM, Denmark, Luxemburg, Croatia, UAE, Austria, Armenia, Romania, Belgium, United Kingdom, Slovenia, Bosnia and Herzegovina, Portugal and others.

Indefinite.

The need for exemption is linked to the regional characteristics of the cross-border provision of road transport services as well as with the necessity to protect integrity of road transport infrastructure and environment.
