摘要： 土耳其於2018年8月15日透過WTO爭端解決程序，針對美國對特定進口鋼鋁實施額外關稅與進口配額之措施，以及給予特定國家豁免之措施請求進行諮商。土耳其指出，美國陸續於3/8、3/23、4/30及5/31陸續發布總統公告，決定對來自阿根廷、澳洲、巴西、韓國出口之鋼鋁豁免額外關稅並實施數量配額限制，其他國家之鋼鋁則分別實施25%或10%的關稅。然而，美國進一步在8/10發布公告決定自8/13起對土耳其出口鋼鐵徵收50%的關稅，並表明未來考慮對鋁材加徵20%的關稅。基此，土耳其主張美國系爭措施構成1994年GATT第19條及防衛協定下之防衛措施，並違反下列WTO相關規定: (1)1994年GATT第1.1、2.1(a)(b)、10.3(a)、11.1、13.1、19.1(a)條； (2) 防衛協定第2.1、2.2、3.1、4.1、4.2、5.1、7、8.1、9.1、11.1(a)(b)、12.1、12.2及12.3條。 另ㄧ方面，土耳其認為美國系爭措施的適用結果，使土耳其於1994年GATT下之利益受到剝奪與減損，且使GATT之目的受阻，屬於1994年GATT第23.1(b)條和DSU第26.1條之情形。至於美國主管機關對於1962年貿易擴張法第232條款之解釋，違反前揭1994年GATT及防衛協定之規定，以及WTO協定第16.4條。 土耳其將保留在諮商程序中，就上述事項依據WTO涵蓋協定下之其他規定提起額外事實及法律請求之權利。土耳其並期待收到美國對諮商請求之回應，以便確定雙方同意之諮商日期。
