摘要：

瑞士於2018年7月9日透過WTO爭端解決程序，針對美國對特定進口鋼鋁實施額外關稅與進口配額之措施，以及給予特定國家豁免之措施請求進行諮商。瑞士指出，美國自2018年3月23日起除了加拿大、墨西、澳洲、阿根廷、韓國、巴西與歐盟等會員外，對所有進口鋼鋁課徵額外關稅並實施進口配額措施，而對瑞士出口至美國之鋼鋁產品造成不利影響。基此，瑞士認為美國對瑞士鋼鋁採取之額外關稅與配額限制，違反以下WTO相關規定: (1) 1994年GATT第1.1、2.1(a)(b)、10.3(a)、11.1及19.1(a)條； (2) 防衛協定第2.1、2.2、3.1、4.1、4.2、5.1、7、11.1(a)、12.1、12.2及12.3條。另一方面，瑞士認為美國主管機關對於1962年貿易擴張法第232條款之解釋，違反美國於WTO協定下之權利與義務，特別是前揭1994年GATT及防衛協定之規定，以及WTO協定第16.4條。至於美國採取之232條款措施，則對瑞士於WTO涵蓋協定下之利益造成剝奪與減損。此外，瑞士主張，美國採取違反WTO義務之措施對瑞士於1994年GATT下之利益造成剝奪與減損，符合1994年GATT第23.1(b)條之情形。瑞士將保留在諮商及未來小組程序中，就上述事項，依據涵蓋協定下之其他規定提起額外事實及法律請求之權利。瑞士並期待收到美國對諮商請求之回應，及確定雙方同意之諮商日期。
