The following communication, dated 29 August 2018, is being circulated at the request of the Delegation of Malaysia.

On 2 August 2018, India notified the WTO Committee on Safeguards under Article 12.1(c) on taking a decision to apply a safeguard measure on imports of Solar Cells whether or not assembled in modules or panels, contained in G/SG/N/8/IND/31/Suppl.1-G/SG/N/10/IND/22-G/SG/N/11/IND/17/Suppl.1.

 

As a Member having a substantial interest as an exporter of the product concerned, Malaysia hereby notifies our request for consultations with India pursuant to Article 12.3 of the WTO Agreement on Safeguards. The aim of the consultations is, inter alia, to exchange views and seek clarification regarding the proposed measures and reaching an understanding on ways to achieve the objectives set out in Article 8.1 of the WTO Agreement on Safeguards.

 

Malaysia seeks to hold consultations as soon as possible with the participation of representatives from India investigating authorities. Malaysia looks forward to receiving India’s response to this request.

 

Malaysia reserves all its rights under the WTO Agreement and its Annexes including the Agreement on Safeguards.
