AGREEMENT ON IMPORT LICENSING PROCEDURES

Notification under Articles 5.1‑5.4 of the Agreement[i]

Indonesia

The following notification, dated 20 March 2017, is being circulated at the request of the delegation of Indonesia.

 

1.        (a)      Title / number / date of the law or regulation establishing / changing the import licensing procedure:

            Regulation of the Minister of Trade No. 41/M-DAG/PER/5/2016 dated 30 May 2016, concerning the third amendment of Regulation of the Minister of Trade No. 82/M-DAG/PER/12/2012 on the Provision of Import of Cellular Phones, Handheld Computers and Tablet Computers.  

(b)       If the notified measure refers to a change in an already notified import licensing procedure, please indicate the document symbol of the notification to which change(s) has(ve) been introduced. (In this case please also indicate in Section 3, below, the nature of the changes (i.e. inclusion or exclusion of some goods and a list thereof; contact point for information and/or administrative body(ies) for submission of applications, etc.)):

2.         Information concerning the institution / change of import licensing procedure:

(a)       List of products subject to the licensing procedure (Exact name of the products and/or whenever possible HS code and indication of the exact HS Nomenclature (i.e. 1996; 2002 or 2007).  Abbreviations should be avoided.  In the case of a long list of products, please attach the list as an Annex in Microsoft Word or compatible software.  Please do not use PDF, or photocopies.)

            To encourage the investment climate and simplification of the licensing procedure.

 

            To obtain the designation as Registered Importer (IT-Ponsel) of related products, every company must apply electronically (http://inatrade.kemendag.go.id) to the Ministry of Trade c.q. Directorate General of Foreign Trade enclosing the following documents:

 

            For the devices in 3G network or below:

·    General Importer Identity Number  (API-U) or Producer Importer Identity Number (API-P);

·    Registered Importer designation for companies who already have obtained the document in advance;

·    Statement of Cooperation with at least 3 (three) distributors;

·    Recommendation Letter from Ministry of Industry c.q. Directorate General of Metal, Machinery, Transportation and Electronics Industry.

 

For the devices in 4G/LTE network:

·    Producer Importer Identity Number (API-P);

·    Registered Importer designation for companies who already have obtained the document in advance;

·    Statement of Cooperation with at least 3 (three) distributors;

·    Investment on Industry Recommendation Letter from Ministry of Industry c.q. Directorate General of Metal, Machinery, Transportation and Electronics Industry.

 

            To obtain Import Approval (PI-Ponsel), every company must apply electronically (http://inatrade.kemendag.go.id) to the Ministry of Trade c.q. Directorate General of Foreign Trade enclosing the following documents:

·    Registered Importer designation;

·    Registration of Imported Product (TPP) from the Ministry of Industry cq. Directorate General of Metal, Machinery, Transportation and Electronics Industry;

·    Certificate of Telecommunication Tools and Devices from the Ministry of Communication and Information Technology;

·    Designation Statement from Principal of Brand Holder/Factory/Distributor in foreign country.

(h)       Expected duration of the licensing procedure if this can be estimated with some probability, and if not, reason why this information cannot be provided

            Not later than 5 (five) working days after all required documents appropriately and completely submitted.

3.         Other relevant data or information(i.e. complete title and data concerning the legislation, inclusion or exclusion of certain products from the import licensing regime and list thereof; changes related to the administrative body(ies) for submission of applications, etc.)

·       This Regulation shall be in effect on 1 July 2016

·       The changes of provision in this regulation as follows:

-       Article 4 regarding Registered Importer requirement

-       Article 7 regarding Import Approval requirement

-       Article 13 regarding technical surveillance

-       Article 15 regarding importers report

-       Article 17 regarding revocation of registered importer designation

-       Addition of Article 9A regarding electronic system for import procedure application

-       Addition of Article 24B regarding regulation’s adaptation period

-       Revocation of Article 8A regarding importers obligation

·       Unless amended by this regulation, the Regulation of Minister of Trade No. 82/M-DAG/PER/12/2013 and its previous amendments are still applicable.
