following proposal, dated 26 July 2016, is being circulated at the request of
the Delegation of Brazil.

The [Committee on Subsidies and Countervailing
Measures/Committee on Safeguards]
Regarding Paragraphs 11 and 29 of the Nairobi Ministerial Declaration
which recognize the importance of
the work carried out in the regular bodies of the WTO;
Without prejudice to any outcomes on rules under the
negotiating pillar of the WTO;
Building on the successful experience of the Working Group on
Implementation of the Anti-dumping Agreement;
Mindful of the importance that Members attach to activities related to
sharing experience on complex technical matters;
Considering that Members could agree on further clarification and
perhaps guidelines to the implementation of [Countervailing Measures under the
Agreement on Subsidies and Countervailing Measures (ASCM) / Safeguard Measures
under the Agreement on Safeguards (AS)], bringing coherence to the practices
adopted by Members;
Bearing in mind that any recommendation shall not add new obligations,
nor shall they detract from the existing obligations of Members under the
[ASCM/AS];
Decides as follows:
1.
To establish a Working Group on Implementation
on [Countervailing Measures/Safeguard Measures];
2.
The Working Group on
Implementation shall:
a.
function as a forum where Members will exchange views on technical
matters related to the implementation of [Countervailing Measures/Safeguard
Measures];
b.
prepare recommendations to the consideration of the [Committee on
Subsidies and Countervailing Measures/Committee on Safeguards (CSCM/CSG)] on
issues arising from the application of [Countervailing Measures/Safeguard
Measures], where agreement seems possible;
3.
The [CSCM/CSG] can adopt,
reject or modify any such recommendation, or refer the matter back to the group
for further consideration, either with or without specific guidance or
instructions.
