DECISION FOR THE HS2007 CLASSIFICATION
OF 15 ADDITIONAL "ATTACHMENT B" PRODUCTS[1]
Participants to the Ministerial Declaration on Trade in Information
Technology Products (ITA).[2]
Considering that paragraph 5 of the Annex to the ITA requires that
Participants meet as often as necessary to consider any divergence among them
in classifying information technology products, beginning with the products
specified in Attachment B, and that Participants agree on the common
objective of achieving, where appropriate, a common classification for these
products within existing Harmonized System (HS) nomenclature, giving
consideration to interpretations and rulings of the World Customs Organization;
Recalling that paragraph 8 of the document on the implementation of the
ITA[3]
provides that the Committee of Participants on the Expansion of Trade in
Information Technology Products (CITA) may consider product classification
divergences with a view to ensuring that the actions foreseen in the ITA are
implemented in a coherent fashion by all Participants; and
Observing that divergences in the classification of products "in"
and "for" Attachment B of the Annex to the ITA were reflected in
document G/IT/W/6/Rev.3, and that the classification of 18 products was agreed in the Decision
for the classification of certain Attachment B
products (G/IT/27);
Decide as follows:
1.
Following
discussions in the Committee[4],
Participants agree on the HS2007 classification of 15 additional
Attachment B items as described in the Annex of this document;
2.
Each Participant
shall reflect the agreed classifications in its WTO Schedule of
concessions, as appropriate, following the procedures set forth in the Decision
of 26 March 1980 on Procedures for Modification and Rectification of
Schedules of Tariff Concessions (BISD 27S/25). Participants shall submit
the relevant documentation in connection with such Procedures no later than 31 December 2016;
3.
The WTO Secretariat
shall provide technical assistance to developing country Participants in making
such modifications upon request.

Computers:

the requirements of the user; (3) performing arithmetical computations
specified by the user; and (4) executing, without human intervention, a
processing program which requires them to modify their execution, by logical
decision during the processing run. The agreement covers such automatic data
processing machines whether or not they are able to receive and process with
the assistance of central processing unit telephony signals, television
signals, or other analogue or digitally processed audio or video signals.
Machines performing a specific function other than data processing, or
incorporating or working in conjunction with an automatic data processing
machine, and not otherwise specified under Attachment A or B, are not covered
by this agreement.
