rEPORT (2015) OF THE COMMITTEE ON safeguards

to the council for trade in goods

(ADOPTED 26 OCTOBER 2015)

1 general

1. The Committee on Safeguards performs the functions set out in Article 13 of the Agreement on Safeguards. This report is submitted in accordance with Article 13.1(a) of the Agreement, which requires the Committee to report annually to the Council for Trade in Goods on the general implementation of the Agreement. The report covers the period 28 October 2014 – 26 October 2015 ("period under review").

2. During the period under review, the Committee held two regular meetings, on 27 April 2015 (G/SG/M/47) and 26 October 2015 (G/SG/M/48).

3. Observer governments in the General Council of the WTO have observer status in the Committee. Pursuant to their Agreements with the WTO, the IMF and the World Bank have observer status in the Committee as well. UNCTAD has observer status through a Committee decision. At its regular meetings in 1998, the Committee decided to invite the ACP Group and the OECD to attend Committee meetings on an ad hoc basis.

4. At its April 2015 meeting, the Committee elected Mr Víctor Echevarría Ugarte as Chairperson, and Mr Navamin Chatarayamontri as Vice-Chairperson.

2 notification and examination of safeguards laws and/or regulations of members

5. During the period under review, the Committee continued its review of notifications under Article 12.6 of the Agreement concerning national legislation and/or regulations in the area of safeguards. For Members with such legislation and/or regulations, these notifications consist of the full and integrated text thereof. For Members without such legislation and/or regulations, these notifications inform the Committee of this fact.

6. As of 25 October 2015, one hundred and eleven (111) Members had notified the Committee of their safeguards legislation and/or regulations or made communications in this regard to the Committee (G/SG/N/1/... series; see Annex 1). Twenty-three (23) Members had not as of that date made such a notification. The Chairperson reminded the Committee of the importance of such notifications (G/SG/M/47 and G/SG/M/48).

7. During the period under review, the Committee reviewed the notified (new or amended) legislative texts of the following Members: Armenia; Bahrain, Kingdom of; Brazil; the European Union; Malawi; New Zealand; Qatar; Saudi Arabia, Kingdom of; and the United States.

8. The substance of the review of legislative notifications is reflected in written questions put to Members and written answers to those questions. References to the questions and answers pertaining to each notification can be found in the minutes of the meetings at which the notifications were reviewed (G/SG/M/47 and G/SG/M/48).

3 notifications of actions related to safeguard measures

9. During the period under review, the Committee received and reviewed a variety of notifications of actions related to safeguard measures. The notifications of initiations, the application of safeguard measures, and the termination of investigations without measures received by the Committee during the period under review are summarized in Annex 2. A record of investigations underway and measures applicable as of 25 October 2015 is set forth in Annex 3.

10. Members' comments concerning these notifications can be found in the minutes of the meetings at which they were reviewed (G/SG/M/47 and G/SG/M/48). Members' written questions and answers concerning these notifications can be found in the G/SG/Q2/… series.

4 INFORMATION ON TIMING OF NOTIFICATIONS

11. At its April 2015 meeting, the Committee had a discussion under an agenda item entitled "Information on Timing of Notifications". A Member proposed that the date when each initiation notification (i.e. notification informing the Committee of initiation of an investigation) was submitted be indicated in the relevant annex of the annual report. The Chair noted wide support for this idea, and asked the incoming chair to consult with the Secretariat as to how exactly to amend the annexes of the annual report. 5 CONTINUED NON-NOTIFICATION OF SAFEGUARD MEASURES BY THE RUSSIAN FEDERATION

12. At its April 2015 meeting, the Committee had a discussion under an agenda item "Continued Non-Notification of Safeguard Measures by the Russian Federation". A Member pointed out that Russia had initiated an investigation and imposed a measure on several products, all of which was which was in effect at the time when Russia acceded to the WTO in August 2012. This Member asked Russia to make the relevant notifications. Russia stated that it had acted in full conformity with its WTO obligations and explained that it had already clarified its position and had provided relevant facts at various WTO meetings.

6 DISCUSSION GROUP REGARDING SAFEGUARD PROCEEDINGS

13. At the April 2015 meeting, a Member explained that a meeting of an informal discussion group regarding safeguard proceedings would take place after the Committee meeting. It was not part of the Committee meeting, but the discussion was open to all Members. This Member recalled that this discussion group evolved from a paper submitted to the Committee in October 2012. The topics for that day's discussion were: (1) the rate and amount of the increase in imports of the subject merchandise and (2) unforeseen developments. At the October 2015 meeting, another Member, recalling once again the background and purpose of this informal discussion group explained that topics for that day's discussion were: (1) public hearings and other appropriate means and (2) public file/inspection of file.

7 NOTIFICATION SEMINAR

14. At the October 2015 meeting, the Chair recalled that the Secretariat made a technical presentation regarding notifications at the request of the Members in October 2014. He sought the views of the Members regarding the usefulness of having another similar seminar in 2016. No Member had any views on this issue, and the Committee took note of the situation.

8 other issues Raised

15. At the Committee's April 2015 meeting, the following discussions took place under "Other Business": (i) a Member referred to an investigation by another Member and pointed out that although it was initially excluded from the measure by virtue of Article 9.1 of the Agreement, it was subsequently removed from the exemption list and was re-included into the measure. This Member objected to such action. The notifying Member responded that it understood that its practice of continuous updating the list of exempted developing countries was not inconsistent with the Agreement. (ii) A Member referred to an investigation by another Member and stated that it had serious doubts about this investigation. The notifying Member stated that the investigation was still ongoing, and that the investigating authority was analysing all relevant facts in accordance with the Agreement.

At the meeting of October 2015, the following discussions took place under "Other Business": (i) a Member suggested that the date of the notification of key actions be indicated in Annex 2 of the annual report, and suggested that the chair hold an informal consultation to discuss this matter. (ii) A Member, noting that the practice of the Committee up to now has been to automatically include into the agenda of the meeting actions covered under Article 12.1 and footnote 2 of the Agreement, suggested that the chair hold an informal consultation to discuss the possibility of automatically including into the agenda all notifications submitted to the Committee. (iii) A Member referred to an investigation by another Member and registered its concerns about this investigation. Concerning points (i) and (ii), the Chair, while stressing that the Committee cannot take any decision that day under Other Business, stated that he will convey an informal consultation in due course to discuss these issues.

Notes:

1. The delegation of the Kyrgyz Republic informed the Secretariat on 7 July 2015 that its investigation on white sugar (G/SG/N/6/KGZ/1) was terminated with no measure imposed. In light of this information, this item has been deleted from Annex 3.

The delegation of the Russian Federation informed the Secretariat on 21 September 2015 of certain safeguard investigations and measures which existed on the date of the accession of the Russian Federation to the WTO, currently expired or terminated, specifically measures on imports of pipes of stainless steel (expired on 1 December 2014), certain tableware of stainless steel (expired on 26 December 2012), certain fasteners (expired on 17 March 2014), activated carbon (expired on 7 September 2014), caramel (expired on 7 July 2014) and investigation on imports of graphite electrodes (terminated on 30 August 2012). This information submitted by Russia is available to the WTO Members upon request.^{^[44]}

3. The delegation of the Russian Federation informed the Secretariat on 22 October 2015 that its investigation on woven fabric (G/SG/N/6/RUS/3) was terminated with no measure imposed. In light of this information, this item has been deleted from Annex 3.

4. At the meeting of 26 October 2015, the delegation of India clarified that the investigation on methyl acetoacetate was terminated with no measure imposed. In light of this information, this item has been deleted from Annex 3. At the same meeting, the delegation of Ukraine clarified that the measure on motor cars was terminated on 30 September 2015. In light of this information, this item has also been deleted from Annex 3.
