Communication from the Panel
The following communication, dated 3 December
2018, was received from
the Chairman of the Panel with the request that it be circulated to the Dispute
Settlement Body (DSB).

Article 12.9 of the
Understanding on Rules and Procedures Governing the Settlement of Disputes,
read in conjunction with Article 4.6 of the Agreement on Subsidies and
Countervailing Measures, provides that, when a panel considers that it cannot
issue its report within 90 days, it shall inform the Dispute Settlement Body
(DSB) in writing accordingly and indicate the reasons, together with an estimate
of the period within which it will issue its report.
The Panel in India – Export Related Measures (DS541) was established by
the DSB on 28 May 2018 and composed on 23 July 2018.
The beginning of the Panel's
work has been delayed as a result of a lack of available resources in the
Secretariat. The Panel expects to issue its final report to the parties not
before the second quarter of 2019.
